Before you act: there’s no point in writing comments like: Where’s the zip file? I want the zip file. Can you please send me the zip file?

well well… What can I say? Several people have sent me links to this and other similar news reports, concerned about what is going to happen to dylanchords.
I understand the concern — I share it, and I don’t know what’s going to happen.
On the one hand: I don’t want to go to jail, and I can’t afford a 500,000$ lawsuit. Those are two good reasons to shut down the site right now.
On the other, I keep telling myself that I don’t have much to worry about: all the lyrics are already freely available from bobdylan.com; all the tabs are my own interpretations and “intellectual property” in some sense of the word, I haven’t copied them from anywhere, and god knows I haven’t cast so much as an eye on the official chord books — heaven forbid! (in fact, had the publishers done a decent job on those, I would never have started this site); to my knowledge, chord charts in the form and with the contents you will find on dylanchords.com have not been copyrighted; etc. All in all, if I were the judge, I couldn’t really say that the site is much of an infringement.
Then again, I ain’t the judge.
The Australian Copyright Council writes:

If you own copyright in a musical work or lyrics, you are generally the only person who can:

  • reproduce it: for example, by recording a performance of it, photocopying it, copying it by hand, or scanning it onto a computer disk;
  • make it public for the first time;
  • perform it in public;
  • communicate it to the public (including via radio, television and the internet);
  • translate it (for lyrics); or
  • arrange or transcribe it (for music).

That would mean that I would need Dylan’s permission to arrange the songs, even though the “arrangements” (i.e. tabs) are my own.
However:

Unless a special exception applies, copyright is infringed if someone uses copyright material in one of the ways set out in the Copyright Act without the copyright owners permission. The special exceptions include fair dealing with copyright material for research or study, or for criticism or review.

The disclaimer about “research, study, personal use” etc. is a standard mantra in headers of tab pages, which I’ve never really taken seriously, and I doubt that anyone has — especially not the publishers and copyright holders. Whether or not a use is fair depends on four factors, listed in the US Copyright Act:

• the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
• the nature of the copyright work;
• the amount and substantiality of the portion used in relation to the copyright work as a whole; and
• the effect of the use upon the potential market for or value of the copyrighted work.

I’d say I score a point on #1, but I lose on the other three.

All in all, the situation is too unclear for me to see through it, but also to just sit and wait. I have therefore decided — actually while writing this — to take down the potentially offensive parts of the site until the situation has become clearer. There will be a solution, I’m sure, but until then: have patience! This is not a goodbye, but a “We’ll meet again”

    This is a travesty. First, I think you are more covered than a regular tablature site, because a) this was your work, b) you’reanot a professional, c) you include a fair aamount of criticism and commentary on the transcriptions. This is fair use! If anything, I’ d say, include more commentary/criticism and you should be completely fair game.

    These are exactly the kind of things that I want to investigate further, and I also believe that they wouldn’t come after me first, but should they do, I’d rather be prepared. I’m not as confident as you about the fair use, though. A colleague of mine was prohibited from using some song title (can’t remember which one) as a chapter heading in one of his books… Besides, if I’d have to include commentary and criticism for every song, I wouldn’t have time for much else…
    But I’m not a lawyer, and if you are, you are more than welcome to give me advice :-)

    Anyway, what could be the worst case we can think of? I’d say: That this site has to be down forever. But even this isn’t the end of playing Dylan songs, becourse:
    • Dylan is 65-something. This site covers nearly all material he has done so far, and I’m sure many people have downloaded the zip Archive and are willing to distribute it. (Many thank to Eyolf here: He has not only tabbed all the stuff, he has also made it easily available. We owe him much!)
    • Whatever Dylan releases in the future, I’m sure there will be means to distribute the tabs on that, too. Ever heard of DeCSS?
    Having said that, just one more thing: The whole argumentation is ridiculous. I’m as right-winged as any sane man can be(*), but this is just power & greed & curruptable seed.
    (*) Possibly. But who wouldn’t say that about himself, however left-winged he is?

    I can’t believe this. i’ve been learning songs on the guitar for almost ten years now – it’s practically how i tought myself and progress as a guitar player. i have dylanchords on my favorites and have visited it at least five times a week ever since i found it. it has been a staple on my computer and chalenges google as my other homepage option. i’m truly heartbroken that i won’t be able to look up any more songs by dylan. i’ll have to resort to the old brick and mortar method that i used when i was 16 looking up sublime songs.

    well…to sum up how i feel: i just got off a long days work and i’ve been humming shelter from the storm in my head all day. guess i’ll have to play it from memory from now on, which might not be a bad thing after all.

    get this chords back up as soon as you can. and while you’re at it, throw on the band songs from the basement tapes or give us a link to find them.

    That depends on the definiton one uses. Granted, as “A product of the intellect that has commercial value, including copyrighted property such as literary or artistic works, and ideational property, such as patents, appellations of origin, business methods, and industrial processes,” it’s not, but as “Any intangible asset that consists of human knowledge and ideas,” I’d say it is.
    The most common usage seems to be as an umbrella concept to cover copyrights and patents, and according to that definition, you’re probably right. I like to consider the site as a whole, though.

    This has been the number one source I used when I started playing the guitar four years ago. In fact, until last year it was the only source, and I think it’s fair to say that 90% of what I learned is from this site: From strumming the Am chord to playing “Simple twist of fate” in open D/E tuning. (with the sensation of sounding “just like the record”. I think it was the only song I played for weeks.) And now it’s gone! :-((

    Like many others, I’ve been in this site hundreds (thousands!) of times.
    Since I started playing guitar some years ago, this has been my favourite place for all these things. Not only for the tabs, I’ve slept with “roadmaps for the soul” under my pillow for quite some time. Now most of this is gone, and it’s a real shame.
    I don’t want to get political, I don’t want to say that this whole thing is completely stupid, that we’re getting into 1984 at an incredible speed, that I’m not sure anymore if we will win this battle. Well, I just said so.
    Fortunately, we still have this incredible piece of work in the form of zip files that are free out there. And it’d be great if a version updated 15-dec would appear somewhere (hint hint).
    Thanks again Eyolf. You just can’t imagine what all this means to me, but I guess I can’t imagine what it means to you either.

    the courts look at all four categories as a whole and you really have them all covered well, except the amount used. -so you’re good there

    and the disclaimer -You may only use this file for private study, scholarship, or research. -is an excellent defense

    I’d gladly listen to your arguments (and thanks to all you lawyers and law students who have offered me your assistance :-), but I want to be certain first. As I see it, #1 is my point, #2 is fairly unclear, but if “the nature of the copyright work” means “copyrighted music”, it is my impression that that is rather strongly protected — especially these days, in response to the mp3 trading and such, and the “threat” that the internet poses to the music industry in general. (And, I should add, rightly so, in some respects: I welcome every legal effort to give struggling artists the right to an outcome of their work. That said, the music industry has never worked to the benefit of struggling artists….)
    #3 is an outright lose for me, and I think I would have a hard time defending myself on #4; there is a quite substantial number of downloaded pages every day, and whereas it is my hope that my site may have contributed to the overall value of Dylan’s work by making it more accessible, perhaps also enticing people to buy albums they might otherwise not have bought, it may still have had a negative effect on the market, at least for (crappy) song books.

    This site has been a tremendous help to me over it’s lifetime – and I can not thank the webmaster enough for all of his efforts over the years. I would never have learned to play guitar without him and this site.

    This site should never be shunned. The chords are indeed accurate but they are not copied from exact copies. It is pointless to do this with Bob Dylan music anyway, since each musician who plays it will have a completely unique interpretation, whether he/she likes it or not. I also agree about the lyrics. The lyrics are poetry! I am certain Bob would like his words to be represented accurately. Well, we can’t help the idiots of the law. But it’s a dying shame if this site is shut down.

    To find the zip file everyone is looking for (I’ll just call it “X”) in a version from November 2003: search for “X” to find the exact previous location. Then search for “Wayback Machine” to find a very cool site that stores old web pages intact. Then search for X there and you will find it.

    You don’t have anything to fear from the music companies. Why do you think they are after you?

    You have seen the legal arguments (above) and someone even recommended talking to Bobs lawyer, but has anyone asked you to retract what you had published? Which, by the way, is only commentary. That’s all you’ve ever published, really, is commentary. The specific tabs themselves were only presenting the context, in a very scholarly way, for the commentary, somewhat like footnotes at the bottom of the page or the back of the book.

    Furthermore, Dylan is in the public domain. He is, his songs are, and even more so his voice shimmers and glistens off the face of humanity, the ultimate public domain. And he wants it, why shouldn’t he? Why wouldn’t he? Everytime we say something to someone about him, he grows. Everytime another book is written, he leaves his mark a little deeper, a little longer.

    Sometimes I go into Bethesda and stand there with my D-41 and softly raise my voice little by little through the verses of She Belongs To Me, and then every verse of Desolation Row, Visions of Johanna, maybe Don’t Think Twice, or The Wedding Song, or Tangled Up In Blue. I do it as a tribute. I do it because I want his songs heard. I do it for the sheer joy of singing the songs. You promote that, worldwide. That’s a good thing.

    By the way, so far nobody’s even thought of arresting me.

    And nobody has thought of arresting you, either. Anyway, they would ask you to take it down, if they cared. They don’t.

    Publish your stuff if you want to, don’t if you don’t. But don’t NOT publish it because of some fear of the unknown.

    What a blow to see that all the tabs have been removed from this truely remarkable site. Considering all the crap out there, this is one of the sites that could justify the existence of the internet. The amount of work an dedication that has been put into this is just unbelievable. I have listened to dylan forever, but using this site over the passed few years, has really lifted my journey into the dylan universe. It´s interesting to realize that by attempting to perform the songs and understand how they were originally played, you get deeper into the songs.

    eyolf, as a lawyer I can tell you that if you are based in sweden you will be goverened by Sweedish I.P. law and not US or Australian I.P. law. And this guitar tabs lark is a different kettle of fish from MP3 sites. I think if swedish law had a fair use exemption this site would be covered.

    As a former professional musician, and someone who has spent untold thousands of dollars buying records, tapes and CD’s, I respect and honor copyright. A hard-working songwriter deserves to be reimbursed for his/her hard work and personal struggles which lead to the creation of their music. However, I can’t see how reproducing lyrics and chords online is in violation of this reward since anyone with a modicum of skills can copy down lyrics as they listen to recorded music and easily figure out the chord structure. Websites such as yours simply streamlines the process for the millions of amateur musicians who perform only for themselves and a few friends or family. In fact, I’d argue, that reproducing lyrics and chords of libraries such as Dylan’s encourages those who don’t have a particular recording to go out and buy it, thus contributing to recording sales. I’ve done this myself with Dylan’s and many other songwriters material that I may have heard once or twice, found the lyrics online, and then bought the CD to listen to the original performance. To shut down or go after websites such as yours is ridiculous.

    IT was a free, cool site. But apparently freedom is getting hard to maintain when it is not constrained by the boundaries of the market. I’m not really politically comitted, but i just have the feeling that something’s happening here. Internet is one of the last place that is not fully shaped by economic dictatorship. It looks like it’s getting there.
    Anyway, I managed to get the zip file and I think it is a good initiative to pass it around to maintain some freedom if possible.

    Does the fact that the music you present on the site has no bearing to the music presented in the Dylan songbooks available protect the work in anyway.
    Obviously transferring the tabs from the song books would be a problem. But if you look at most of the songs they’re quite different, and the case seemed to be against accurate reproductions. Not that the site isn’t accurate, but the books are the official righted form and so surely the site’s work is a creative interpretation.

    Yes, but… There are copyrights on several different layers here. The publishers hold the right to the versions they publish, but Dylan holds the rights to the artistic creation, and is entitled to control the publication of arrangements and transcriptions of it.
    Thus, I would have the copyright of any such arrangement or transcription, but in order for me to be allowed to publish it in the first place, I would need Dylan’s permission.

    Well my opinion on the matter is that the legality of their stance is unfounded….a lot of Dylan’s music wouldn’t even EXIST if it wasn’t for appropriating other people’s intellectual propertly. And I believe that the work becomes public domain after 50 or 100 years? I do not know the facts there, though, but according to the first rule of their statement I am not allowed to cover songs by other artists at the local coffeehouses or else…..someone call Homeland Security!

    But the only thing I wanted to say was this: Eyolf has provided an enormous catalogue for us for many years, completely invaluable and well crafted. But, as one of my older friends once commented, tabs have ruined guitarists for a while now. The days when you put the album on and sat there and figured it out for yourself are past, and as a result we become less trained as guitarists and lazy by the dozen. I know my first instict is to google a song rather than take the time to labour over it.

    Another thing for myself, due to Dylan’s common use of capo and C shape voicings, I have become too accustomed to playing in certain keys and shapes. This is because I play so much Dylan, and Eyolf puts it in the most convenient position. But, when I listen to some old jazz tunes and sit there and try to pick out those chords, I am way prouder of myself when I succeed and given to try more! Now we can all enjoy that warm fuzzy feeling when you figure out for yourself that well loved Dylan tune you always wanted to play but never could!

I am not sure this is the case, I think Dylan has a certain amount of decisional power on this matter, but for sure also Columbia or whoever Dylan has sold the rights for publishing transcriptions of his music should give its permission…

    I just found out about this and it is very upsetting – but not unexpected. This is copyright gone crazy and there’s probably nothing you’ll (or any of us) be able to do.     A way round this may be to ask several people to host dylanchords on their own server or the zip file with you publishing the links on your site. You would anly neeed to provide a page where the fans could insert the URL where the zip file can be found or dylachords site is (a moving target for MPA – could be some spamming problem but I’m sure this can be overcome).

    Can you send me the zip file.

    Also, do you have a donation page where dylachords fan could donate some money for you to get some legal advice.

I think it is a shame to remove tabulature sites, because they encourage the purchase of albums, at least in my case. I think this site does nothing more than honor Dylan and mostly likely encourage people buy more Dylan.     This is just another case of the music industry going after the wrong people.     I’m 51 years old and first heard Bob’s music in the summer of 1968 when I was 13. It’s been a very imprtant part of my life. I picked up the guitar a few months later and tho I play badly I find that singing the songs gives you a diffferent, and in some ways, more intimate experience of them. I remember the excitment I felt when I bought my first chord book in 1969 or so and thnking “what is this shit?” when I found many of the songs in unplayable e flat minor. I figure the MPA owes ME money when you figure the interest on that original $5 piece of crap. IF they would actually bother to put out a songbook that we could use, we might be willing to pay for it.

But you come so close or exactly to what I hear bob play. Another thing is Dylan himself was a “stealer of music” listening to records and learning to play those songs. I’m sure he believes in sharing music in the sense that other people can learn to play songs that aren’t theirs. I just don’t understand how people can try and do illegal things by knowing a song.     Fuc… Shame! Iam from the Netherlands and saw Bob’s first stadiumconcert in The Netherlands in 1978. After that I saw him about 200 times from Holland to New york, Woodstock and so on. Iam playing his song over more than 30 years and discoverde your site a while ago. I was teaching myself specialy the basement tapes songs, because the way you find out the lyrics & chords are very impressive.     Just had a thought, as it’s the American Music Publishers’ Association that is kicking up a fuss, could you not just put the songs back on but put a note on the site saying that if you are in America, it is illegal to view the files?     You are simply making available to the public your intrepretation of how certain Dylan songs are played.
    I have a few friends that are lawyers, and rest assurred that this situation will be brought to their attention, and I will pass on any advice or information I receive.
    This sire has been a great educational tool for me over the past 2 years, and I would hate to see it shut-down. The greater tragedy, however, would be if you were to face legal action personally.
    It would be great if you put up the zip file on the site for a week or so to let us all get at it… or start it as a bit.torrent and give us the information on how to find it.

    Man this site is cool! We all can talk about this and that, ultimately you make the choice! Is the creator of this site as guilty as the viewers and if so is that right? Of course its not! The songs are great and it’s in everyone’s best interest to keep them alive.     Because of your site I have purchased 23 Dylan CDs in the last year (ouch)! The only reason I decide to purchase one is that I see an interesting song (or version) in tab format, usually here at DylanChords. I then listen to the first 30 seconds at BobDylan.com, if I like it and want to play it, I purchase the CD so that I can listen and learn the entire song. Without the tabs I would never have became interested in the music (and made no CD purchases). I have also purchased a Dylan tab book with over 300 Dylan tabs in it, however the quality was generally poor.
    My interest level in buying more CDs was very high but has dropped to minus zero as a result of the tab site issues (in particular with DylanChords.com), I don’t just want to listen to the music, I want to try playing it, the tab sites give me that basic opportunity, saving hours of time. I guess I will just have to spend the time myself…should be fun anyway…of course time is the big issue.

    I really hope yours site comes back. Obviously a labor of love….beautiful work Eyolf .

    New Year 2005 myself and other musicians from the north east of England (some of whom had even shared a stage with the man himself) held a “Dylan Day” and raised a great deal of doe for a newcastle neurosurgical unit.
    The concept was simple, provide a great house band and invite all and sundry to front it and perform a Dylan song – from 3pm till midnight and NO repeats. Dylanchords was the standard backing sheet for each number.
    Some of the performers were in their teens some in their sixties but all had love and respect for Dylan’s music which is only enhanced by your superbly scholarly site.
    Music publishers just don’t get it,you might as well talk about closeing public libraries.

    In any event, I can’t help but wonder if certain artists aren’t in fact cutting off the nose to spite the face, as far as “reigning in their fans”. At this point, I wouldn’t go to a grateful dead show if somebody offered to pay me. I am SO pissed!

    I’ve read all the above, and realise that this has been said many times over, but I just felt I had to say something in support. I’ve been visiting your site for several years, and I’ve very much appreciated the efforts you’ve put into creating it – not just the tabs, but all the other good stuff that’s helped both my guitar playing and my enjoyment of Bob’s music.

    I’m 56, first got into Dylan when I was 16 – maybe I’ll do a 40th anniversary concert featuring the songs I’ve learnt from you!!!. I’ve got all his albums, saw him at the Isle of Wight in 1969, and in Manchester this year.

    I’ve seen a few helpful suggestions in the comments above (e.g. ask Bob’s permission, register the site in a country where it’s legit) – might be worth putting something on here to say what you’ve considered, and what the outcome was. If nothing else, it might stop your fans repeating the same things – although maybe not, given the number of people that are still asking you to send them a zip file, without bothering to read through the comments!

    Anyway, I wish you every success, and hope to see your site restored to its former glories before too long.

I admit, we live in a different world now and aren’t all singing and playing and learning songs with our families, but this was (in a way) a continuation of this tradition – learning from others and passing the songs along.     I’m 37. When I was in my late teens and early twenties I was obsessed by music but grew ever more cynical about the industry as I grew older. I stopped buying records altogether by the time I was 25 because most of the music I came across was rubbish.

    7 years ago (when I was 30) I got broadband internet and discovered Napster. First I started downloading old tunes I’d heard from my childhood. I came across loads of fantastic country, bluegrass and folk music by accident. This led to the discovery of many artists that just don’t have an outlet for their music on the radio in the UK.

    Since this rediscovery of music via the mp3 revolution started I have purchased more legitimate music cd’s than ever – i now spend a fortune on the damn things. The difference is now I buy exactly the music I like from Amazon or iTunes and not whatever the record companies think I ought to like and can be bothered to stock my local CD store with.

    The parallel with the Tab sites is uncanny. Do they really think people buy less Bob Dylan records and merchandise because of your site?

    I agree with much of what has been written. I definately think you should ask Bob what he thinks.

    Lastly, like everyone else I thought the site would be around forever but it seems, as with altcountrytab.com I’ll have to plead with you for the zip file and if there is anything a web developer from Sussex, UK can do to help then please let me know.

Any time I felt like strumming a Dylan song on guitar, this was the place I’d come (not good enough to play any of the songs from memory!) and I’ve spent many hours using these tabs to play along to Dylan’s CDs. Anybody that thinks this site will affect music record sales is a fool, in fact as many people have already said it almost certainly does the opposite. I seriously wonder how Dylan feels about this whole thing. I would like to think if (and when) he hears about it he will do what he can to help get this site back up and running – surely he knows the importance of music being shared and played and loved by others. After all, he started off as a someone playing covers of old folk songs. Hope to see the site back up + running soon!

    Your site is/was the best Dylan site on the ‘net. Your chord arrangements were by far the best available — for free or for money. Right now, there is a huge, fat Bob Dylan song book down at my local public library. It has virtually all the Dylan songs in it, chords and lyrics. But I came HERE, because your chords were better. And your comments and analysis helped me understand and appreciate Dylan and his music more.

    By the way, according to your posting of the Australian copyright people, I can’t “perform it in public.” So — No singing of the songs in public? I can’t play Blowing in the Wind in a coffeehouse, or play Like a Rolling Stone at the local bar with my band?

    You know, they that that “those whom the Gods would destroy, they first make mad.” I think the greed of the music industry is causing them to lose their basic good sense. They are trying to prevent people from using and participating in their culture. If they persist, people will simply replace commercial music in the culture with something else, because people WILL NOT agree to give up their culture to others.

    If we can’t play and sing the songs distributed by the music industry, we will sing and play what we CAN sing and play. Simple. That is not a threat, it is a description of human nature!

    I would, therefore like to say a big thanks to you for the huge ammount of time and effort that you must have put into this site and how much I’ve enjoyed visiting it and watching it grow – and not only the tabs, I’ve enjoyed the other essays like ‘Dylan’s Guitars’.
    I’ve been a Dylan fan since I was 12 in 1965 and I love to pick up a guitar and delve into his massive catalogue of songs.
    I’m afraid it looks like what we have here is a classic case of little guy vs the huge corporation and unfortunately, despite what we see in the movies, the little guy seldom if ever wins.
    I think it’s a great shame, particularly after a year of more openess and access from Dylan than I’ve ever known.

    I am deeply saddened by this news. As it was for many, I too was inspired by Dylan to learn guitar. I worked hours every day, listening to recordings and looking up every song on every album I owned on this very site. It was you, Eyolf, who helped me to become a decent guitarist. It was this site that encouraged me to buy the very albums they wish to protect. I tell you this, without this site I would not be where I am today.

    Using the tabs on dylanchords my friends and I would go busking in downtown Iowa City (USA) playing every song we knew from Leadbelly to Guthrie to Bob himself. Sure we didn’t make much, but the experiences and friendships formed were worth every hoarse voice or numb finger. I recall when I found a bunch of bootlegs my father had stored away and found the tabs to them here on the site. The sheer joy at being able to exactly replicate the sound of his voice or the licks on the guitar brought me lasting satisfaction. Using the simple chord structures laid down by generations past I began to write my own things, beginning with “Song to Bob” a tribute much like his first.

    The MPA has a legal claim to do what they have done. I am deeply sorrowful that this has come to pass. I feel in my heart that you have done a great service to this world Eyolf, but I am torn. I also understand the value of copyright. I know how much intellectual property means to a writer. I am sorry I haven’t got anything else to say, just that I know that Bob wouldn’t give a damn about any of it. He realized he could become greater than Woody, he used him as long as he needed and when he moved on he thanked him in a song. If anyone wants to be stuck playing covers of Dylan their whole lives, go ahead, I say, it won’t get you as far as you need to go.

    I signed the petition. I humbly think that these legislators are ignorant. They don´t have an idea of what rock music is, they ignore the specificity of it. They seem to ignore that it always has been a popular music, and that is only commercial, obviously if they want to sell some object. The interpretations of music, and tabs are really interpretations, do not steal any element of that physic object that carries the musical product. It is obvious that they are unfamiliar with the reality of all this. I somewhat unwillingly admit that there is some manoeuvre of commercialism. They would if they only could!). Another approach may be something like open source, just search for “open source beer”. Anyway, something is happening: Music gets in the hand of marketing people and lawyers. There is no room for living this music by playing or understanding it, its just about consuming.     Eyolf, you gave me insight in songs I would not have got and I thank you for that. And Bob Dylan may not take any notice of it, but as somebody above said: He would vote to keep this site up. Who knows where Dylan himself would stand on this issue – it seems he could learn a song the moment he heard it. Bottom line, I agree with the others who have commented that it makes him more money from increased interest in his music than it would ever cost him from lost sheet music sales.     i sent you some e-mails years and years ago about some dylan song information…(can’t remember what it was, now) anyway, i organize a yearly dylan tribute in ann arbor, MI, U.S.A. and I used to tell everyone who asked about this guy named eyolf who had this brilliant dylan site that had boat loads of information, and the tabs were always done very well. sorry to hear about this. you know, i just remembered…it was something about “Deep Elum”.
